Why is important to sign a contract with registered company for elevator maintenance?

Много често към нас се обръщат хора, с въпроса защо е важно всеки ползвател,  да има сключен Договор за поддръжка и ремонт на асансьора. Тъй като разбираме, че материята е неясна за всички, бихме искали да помогнем и на останалите да разберат колко сериозен е въпросът.


WHAT ARE THE LEGAL REQUIREMENTS?

We will introduce you to some of the normative regulations concerning elevators and practical issues in Bulgaria.

Let's start with the requirement of the State Agency for Metrological and Technical Surveillance, in short SAMTS on regulating the relations between the user, ie. You and the elevator maintenance company. 

In Art. 7 of the Regulation on the Safe Operation and Technical Supervision of Elevators is written:

"The users of elevators are obliged to conclude written contracts for their maintenance, reconstruction and repair only with those registered in the register under Art. 36, para. 1 of Technical Requirements for Products Act, persons performing maintenance, repairs and reconstruction of elevators, and may at any time change these persons. "

This text obliges all users to sign a contract with a maintenance and repair company for elevators. You choose the company yourself, but it must be registered in the Register under Art. 36, para. 1 of the Technical Requirements for Products Act. IN ADDITION

Удостоверението дава право на фирмата да упражнява дейност по поддържане, ремонтиране и преустройване на асансьори.  Освен че е необходимо да има издадено Удостоверение, е задължително тя да издава фактури за абонаментното обслужване и за ремонтите, които извършва на асансьора. По този начин Вие, ползвателите, можете да сте сигурни, че отговорността, която е споделена между Вас и фирмата. В  случай, че не получавате оригинални фактури, тази отговорност във всеки случай се носи само от Вас. Така Вие по никакъв начин не можете да потърсите правата си в случай на нередност.

To ensure that you receive original invoices and adhere to all common accepted practices for servicing your elevator safely and in a timely manner, DO NOT allow:

  • the maintenance of your elevators is carried out by persons who are not registered in the Register under Art. 36 para. 1 of the Technical Requirements for Products Act
  • invoices without a cash receipt in case you pay in cash
  • lack of documents and certificates to parts when carrying out reconstruction
